Los Angeles, CA- Child custody is a vexing issue for divorcing couples and battles over the issue can get ugly. Regrettably, some estranged spouses use child custody as a way to gain an advantage and hurt their ex. There are a number of ways child custody can be used negatively, take for example the recent actions of actress Angeline Jolie.
Angelina Jolie and Brad Pitt’s child custody saga
Hollywood A-listers Angeline Jolie and Brad Pitt are involved in an ugly and public divorce and child custody battle since September of 2016. It all began with Jolie accusing Pitt of child abuse, which he was cleared of, and this is just the latest move to embarrass Pitt perhaps.
The New York Daily News reports that earlier this month, Jolie publicly published the terms of her divorce agreement. Under that agreement, Jolie has sole physical custody of the couple’s six children. Pitt has visitation rights, but it is very restricted leaving a psychologist in control of the terms, according to TMZ. As part of the agreement, Pitt must submit to random weekly drug testing.
Speaking to the New York Daily News, a child custody attorney said there are few reasons why Jolie would file a complaint and made their child custody arrangement. One, she may think Pitt is violating the terms of their temporary custody agreement and need a court record. Or, she could be thinking about modifying their child custody arrangement.
We don’t know the motive behind Jolie’s choice to release their child custody arrangement to the public. But in some cases, a public disclosure like or a filing a court motion can be used to illicit a negative response from one spouse. Family courts tend to prefer joint custody arrangements unless such an arrangement poses a risk to a child, so some parents will take extreme steps to make their estranged spouse look bad.
How do California’s family courts decide contentious custody cases?
Family courts in California will take several things into consideration when determining child custody including if there is a history of child abuse or spousal abuse, drug abuse or alcoholism or one spouse abandoned their children and marriage. The best interest of a child takes precedence in family court and judges can often see beyond tactics that are employed to malign their spouse wrongfully.
